Jihād Becomes Fardh ‘Ayn In 3 Cases

Ibn Qudhāmah said:

“And jihād becomes an individual obligation in three situations:

The First: When the two groups meet and both sides face one another. It is forbidden for those present to flee and that situation is an individual obligation to him, due to Allāh’s statement, “O you who believe, when you meet (an enemy) force, take a firm stand against them and remember Allāh much…” until His statement, “… and be patient, surely Allāh is with those who are patient.” [8:45-46] And His statement, “O you who believe, when you meet those who disbelieve in battle, never turn your backs to them. and whoever turns his back to them on such a day – unless it be a stratagem of war, or to retreat to a troop (of his own) – he indeed has drawn upon himself wrath from Allāh.” [8:15-16]

The Second: If the disbelievers enter a country then it is an individual obligation upon its people to fight them and repel them.

The Third: If the leader (Imām) calls upon a people, it is upon them to go out with him, due to Allāh’s statement, “O you who believe, what is the matter with you that when you are asked to march forth in the path of Allāh (i.e. jihād) you cling heavily to the earth?” [9:38] as well as the verse which follows it. And the Prophet (saw) said, “If you are called out, then go out.” [Agreed upon]”

Note: As an extension to the second case, it remains as such until that land is returned to the domination of Islāmic Law, irrespective of how many years have passed since we lost that specific land. And it is precisely this which lead many leading scholars to state that jihād remains fardh ‘ayn until as far west as Spain and until far east as the borders of China and the borders of Russia are returned to Islāmic Law.


How The Orientalists Plot Against Islaam

Some Muslims have been deceived by the guise of ‘scholarly research’, which the enemies of Islaam use as a front for their nefarious activities… It is clear that some Muslims have become ensnared in their traps for one of four reasons:

1) They are ignorant of the realities of our Islamic heritage as well as of its pure sources and pristine teachings.

2) They have been deceived by the ‘scholarly research’ that the enemies of Islaam claim for themselves.

3) They desire fame, wanting to give the appearance of free and libertarian thought, after having freed themselves from the shackles of blind following, which they attribute to Islaam.

4) They are driven by deviation and desire and find no way to express their feelings except by hiding behind the shield of Orientalists and misguided Western authors who write about Islaam. [p. 36]

Those who conspire against Islaam have varied in their methods and in the execution of those methods over the centuries. When Muslims were strong, their attack took the form of intellectual and cultural invasion. When the muslims were weak, their attack took the form of military warfare, the goal of which was to annihilate all Muslims. If war did not produce fruitful results, they would resort to deception, intellectual as well as cultural warfare. Within the boundaries of Islamic territory, they would infiltrate the ranks of Muslims, disseminating morals and ideas that were contrary to the basic tenets of Islaam. [p. 475]

At the university of Edinburgh, the orientalist who was the Dean of the faculty of Islamic Studies was a Christian priest. And the Dean of Arabic Studies in Glasgow was also a priest who has been a missionary in Palestine for almost twenty years. In Oxford, the Dean of Islamic Studies was a Jew who previously worked for the British Secret Service in Libya during the second world war. [p. 44]

They (these ignorant Muslims)  hastened to accept and take from Orientalist books, being deceived into thinking that their knowledge was vast, and moreover, being deceived into thinking that they only spoke the truth. They felt that Orientalists followed a precise set of principles in their ‘scholarly research’, from which they never deviated. And this is how some Muslims came to trust the research and studies carried out by Orientalists. [p.52]

1) Imitating them in dress and lingo

2) Residing in their lands and not moving from their lands to the lands of the Muslims to save one’s Deen (i.e, hijrah).

3) Travelling to the lands of the kuffaar for tourism and vacation.

4) Helping them, giving them victory over the Muslims, speaking well of them and defending their honour.

5) Seeking their aid, trusting them, putting them in positions to know the secrets of the Muslims and making them advisors.

6) Using their calendar instead of the Islaamic calendar and, more importantly, observing the holidays on their calendar, like Christmas etc.

7) Observing their holidays or helping them to make that celebration or congratulating them for their holidays or just being present at their celebrations.

8) Speaking well of them through what they have of material wealth and being satisfied with their behaviour without looking at their deen which is a false deen.

9) Using their names.

10) Supplicating for them and being compassionate to them.

American Rape Statistics:

In 1995, over 354,670 women were the victims of rape or sexual assault. (National Crime Victimization Survey. Bureau of Justice Statistics, U.S. Department of Justice, 1996)

Over the last two years, more than 787,000 women were the victim of a rape or sexual assault. (National Crime Victimization Survey Bureau of Justice Statistics, U.S. Department of Justice, 1996)

The FBI estimates that 72 of every 100,000 females in the United States were raped last year. (Federal Bureau of Investigation, Uniform Crime Statistics, 1996)

Somewhere in America, a woman is raped every 2 mins. (US. Deprtment of Justice)

Silent Victims:

Approximately 28% of victims are rapd by husbands or boyfriends.

35% by acquaintances.

5% by other relatives. (Violence against Women, Bureau of Jusice Statistics, U.S. Dept. of Justice, 1994)

According to the FBI estimates tat only 37% of all rapes are reported to the police.

According to the U.S. Justice Department, only 26% of all rapes are reported to the police/law enforcement officials.

Living In Fear:

According to the U.S. Department of Justice (All statistics are taken from: Violence against Women, Bureau of Justice Statistics, U.S. Dept. of Justice, 1994)

25% of every rape takes place in a pubic area or in a parking garage.

31% of female victims reported that the offender was a stranger.

68% of rapes occur between the hours of 6pm and 6am.

At least 45% of rapists were under the influence of alcohol or drugs.

In 29% of rapes, the offender used a weapon.

In 7% of rapes, the victim sustained injuries other than rape injuries.

75% of female rape victims require medical care after the attack.

We sincerely ask Allaah for leaders who are His close allies;
For good in the deen and the dunya comes from good leaders.

People are united and joined in giving them the highest praise;
And with them, Allaah’s laws are established and maintained upon the transgressors;
And they are a benefit to us in places of difficulty and hardship;

Knowledge disappears, as the scholars disappear;
For they are the ones who support Allaah’s Deen in the vast earth;
So we ask Allaah to reward them commendably.

1) Honoring the Muslims in their gatherings, and to not plot against them, and to not enter upon them without their permission, and to not act impolitely or disrespectfully in their presence, and to greet them with the best of greetings, and to not extend their feet or raise their voices in their presence.

2) To rise for the Muslims in their own gatherings; meaning: if they enter upon us (the people of dhimmah) while we are in a gathering, then we get up from our places and offer them to the Muslims instead, so that they would have the best spots and we would have the farthest.

And this includes gatherings that are both mixed (containing Muslims and non-Muslims) as well as exclusive (only non-Muslims). So, if they enter upon them in their churches, for example, then they are to get up from their places and sit them (the Muslims) down in their place.

3) They are not to live in a residence that is in any way elevated above the residence of the Muslims. This is clear in that they are not to be above them even in their places of residence; so, they are not to live in an abode that is elevated above that of a Muslim because this is a form of dominance over them, and this is what we worship Allah by and do not believe in anything other than it: that it is not perceivable that they are to be above the Muslims in any way, shape, or form.
