Muslim Prisoners Of War

Ibn Hajar Al-Haythami said:

“If the enemy captures a single Muslim, it becomes wajib (obligatory) on everyone who has the ability to rush to their rescue (even without seeking anyone’s permission). It is apparent that it is compulsory on everyone, similar to the situation where the enemy invades our land. Moreover saving our brothers is of a higher priority, as the sanctity of a Muslim is greater (than the sanctity of a State).”

Ash-Shaheed Sayyid Qutb said:

“They spend their money, concentrate their efforts and use all their ability to turn people away from the path of Allaah. They set up obstacles to impede the progress of this religion and to suppress the Muslim community everywhere and at all times.

This war against Islaam will not stop. Hostile forces will not leave this religion alone. They will not allow its followers any time of peace and security.

Hence, the method of this religion is to move forward to attack jaahiliyyah.

It is the duty of its followers to take pre-emptive measures to smash the ability of jaahiliyyah to wage aggression, and then to raise Allaah’s banner high, immune from attacks by its enemies.”

Burning Someone With Fire, Part 7 (By Ibn Rushd)

Burning With Fire, By Ibn Rushd:

Ibn Rushd said:

“The proscription of mutilating the bodies of the enemy is fully established. The Muslim jurists (fuqahaa) agreed on the permissibility of slaying them with weapons, but disagreed about burning them with fire.

A group of jurists disallowed burning them with fire or even attacking them with it, and this is the opinion of ‘Umar and is also narrated from Maalik.

Sufyaan Ath-Thawree permitted this, while some of them said, ‘If the enemy initiates this then it is permitted, otherwise not.’ “

Showing Hospitality Towards The Captives Of War

Abu Azeez Ibn ‘Umayr Ibn Haashim was the brother of Mus’ab Ibn ‘Umayr and was fighting the Muslims on the battle of Badr. He was the holder of the banner of the kuffaar next to Al-Nadr Ibn Haarith. When he was taken as captive by the Muslims, he said:

“I was assigned to a group of the Ansaar. When they laid out their lunch or dinner, they would give me the bread while they themselves ate dates without bread. This was because of the Prophet’s instructions to them. Every time any one of them had a piece of bread, he would give it to me.

Sometimes I felt embarrassed by their hospitality and I gave the bread to any one of them who was around. He would return it without taking a single bite”

The Bravery Of ‘Ali Ibn Abee Taalib

‘Amr Ibn ‘Abd Wudd had fought on the day of the battle of Badr until he was badly wounded, so he was not present on the day of Uhud but when the day of the battle of the trench came, he marked himself to show his position.

Then he and the other horsemen took up their positions and said, “Who will come out to duel?”

‘Alee Ibn Abee Taalib came out to him and said to him, “O ‘Amr, you have promised Allaah that if any man of Quraysh gives you one of two options, you will accept one of them.”

He said, “Yes.”

‘Alee said to him, “I call you to Allaah and His Messenger and to Islaam.”

He said, “I have no need of that.”

‘Alee said, “Then I call you to a duel with me.”

He said to him, “Why, O son of my brother? I do not want to kill you.”

‘Alee said, “But by Allaah, I want to kill you.”

‘Amr got angry at that, so he dismounted from his horse, hamstrung it and beat its face, then he turned to ‘Alee, and they fought, circling around one another, until ‘Alee killed him  and their cavalry fled, bursting headlong in flight across the trench.

Running Away From The Battlefield, By Sayyid Qutb

Sayyid Qutb said:

“To flee from battle deserves such condemnation because of the magnitude of its serious consequences on the one hand, and because it has a bearing on the very question of having faith. A believer should be firm and resolute, able to resist any force on earth, since he believes that Allaah’s power can overcome all powers.

If a believer’s heart experiences a tremor at a moment of danger, such a tremor should not go as far as making him flee from battle. The moment of anyone’s death is determined by Allaah alone.

Hence, no believer may flee from battle fearing for his life. This should not constitute too much of a burden for anyone. A believer is a human being who encounters an enemy, who, in turn, is a human being. hence, they are of the same nature. The believer, however, has the advantage of relying on the overpowering might of Allaah Himself. Moreover, he is under Allaah’s care while he is alive, and he entrusts himself to Allaah’s care if he attains martyrdom.

This means that in all situations he is stronger than his enemy who defies Allaah and His Messenger. Hence this absolute ruling: “And whoever turns his back to them on such a day – unless it be a stratagem of war, or to retreat to a troop (of his own), – he indeed has drawn upon himself wrath from Allah. And his abode is Hell, and worst indeed is that destination!

Killing By Mutilation Is Unislamic, By Imaam Ash-Shaafi’ee

Ash-Shaafi’ee said:

“When the Muslims captured some polytheists and wanted to kill them, they killed them by beheading, but they did not go beyond that. They did not mutilate them by cutting off hands or feet or any part of the body, or stabbing them in the stomach or burning or drowning or anything beyond what was described, because the Messenger of Allah (saw) forbade mutilation.”

From The Booty Received After The Battle Of Al-Qaadisiyyah

‘Asmaa Ibn Al-Haarith Ad-Dabbee said:

“I went out with those who went out seeking booty, and I followed a well-travelled path where I saw a man on a donkey. he ran away and caught up with another who was in front of him. They turned and ran with their donkeys until they came to a river where the bridge was broken. They stayed there until I caught up with them, then they parted. One of them threw something at me so I chased him and kiled him, and the other one ran away.

I went back to the two donkeys and brought them to the one who was collecting the plunder. He looked at what the first one was carrying and there were two saddlebags. In one was a horse made of gold with a saddle of gold and a bridle of rubies and emeralds set in silver, and reins of similar fashion. And there was a knight made of silver, studded with jewels.

In the other bag there was a camel of silver on which was a saddle of gold and riens of gold. All of that was adorned with rubies, and on it was a man ade of gold studded with gems.

Chosroes used to keep them in the columns in his palace on which their history was engraved.”
